Eligibility

Access to Nivara services requires that users meet applicable eligibility criteria, supply accurate information during registration, and comply with these Terms. Certain courses or coaching services may have additional prerequisites which will be described on the relevant course page.

Users must be at least 13 years old to register for Nivara services. Users under the age required by local law to contract must obtain parental or guardian consent where applicable. Nivara may decline to provide services to individuals who cannot lawfully enter into these Terms.

You agree to use the Nivara platform and services only for lawful purposes and in a manner consistent with these Terms. Prohibited conduct includes any activity that would violate laws, infringe the rights of others, or compromise the security of the platform.

Services offered by Nivara may not be available in all jurisdictions. Access may be restricted due to local law or regulatory requirements. It is your responsibility to review and comply with any laws applicable in your jurisdiction before using our services.

Services Provided

Nivara provides structured online courses, workshops, and coaching focused on personal mastery, leadership, mindset development, and professional growth. Course content includes recorded lessons, exercises, downloadable materials, and live sessions when specified. Course descriptions and schedules on jcinova.tech indicate the scope and format of each offering.

Nivara may modify course content, delivery schedules, formats, and features from time to time to reflect improvements, new research, or operational considerations. Registered learners will be notified of substantive changes that affect access or course requirements.

Nivara makes reasonable efforts to maintain the availability of its platform and course materials. However, access may be interrupted for maintenance, updates, or events beyond our control. Nivara does not assume responsibility for outages caused by third-party providers, internet service interruptions, or force majeure events.

User Content

Users may submit content such as feedback, comments, assignments, and forum posts (“User Content”) while using Nivara services. User Content is subject to these Terms and the community guidelines communicated within course spaces.

You retain ownership of the intellectual property rights in the original User Content you submit. By submitting User Content you represent that you have the necessary rights to grant the permissions described below.

By posting or submitting User Content, you grant Nivara a non-exclusive, worldwide, royalty-free license to use, reproduce, distribute, adapt, and display that content as reasonably necessary to provide the services, promote educational activities, and operate the platform. This license does not transfer ownership and may be revoked by deleting the content where applicable and subject to retention requirements.

You are responsible for the accuracy and legality of your User Content. Do not post confidential information or personally identifying information of third parties without explicit consent. Content that violates laws, infringes on third-party rights, or breaches community standards may be removed.

Nivara reserves the right to remove or restrict access to User Content that violates these Terms, infringes rights, or is otherwise inappropriate. If you believe your content has been removed in error, contact our support team with details and we will review the decision.

Paid Services

Certain Nivara courses, coaching packages, and premium resources require payment. Paid Services are described on jcinova.tech along with applicable fees, billing intervals, and any trial periods. Enrollment in paid offerings is subject to these Terms and the specific purchase terms presented at checkout.

Course and service prices are set on the website and displayed in Canadian dollars unless otherwise stated. Prices exclude taxes, duties, and other governmental charges which may apply at checkout. Promotional pricing and discounts are subject to specific terms and expiration dates.

Payments are processed through secure third-party payment processors. You agree to provide accurate payment information and authorize the charge of applicable fees for all purchases. Nivara does not store full payment card data on its servers; such data is handled by PCI-compliant providers.

Subscription courses or memberships bill at the intervals specified during sign-up and will continue until cancelled. Cancellation procedures are provided in your account settings or at the time of purchase. Cancellation stops future billing but does not automatically entitle you to refunds for prior periods.

Refunds are considered on a case-by-case basis and depend on the nature of the course, access provided, and timing of the request. If you believe a refund is appropriate, contact our support team with relevant details and evidence of limited access or issues. Refunds, when provided, will follow the method of original payment unless otherwise arranged.

You may cancel paid enrollments according to the cancellation procedures specific to the offering. Cancelling a subscription stops future charges but may not retroactively cancel access to content already delivered. Nivara may suspend or cancel services for non-payment or breach of these Terms.

Applicable taxes and fees are calculated at checkout and are the responsibility of the purchaser. Where required, Nivara will collect and remit taxes in accordance with applicable law.

Nivara may update pricing for future purchases at any time. Updates do not affect fees already paid for the current term of subscriptions or active enrollments, except where otherwise disclosed at the time of purchase.

Failure to pay applicable fees may result in suspension or termination of access to paid services, withholding of certificates, or collection actions where permitted by law. Nivara will attempt to notify you of payment issues prior to taking action.

Disclaimer

Educational materials provided by Nivara are for informational purposes and intended to support personal and professional development. Content is not a substitute for professional medical, legal, or business advice. Decisions based on course content are the responsibility of the learner. Nivara makes no representations that participation will achieve particular outcomes.

Third-Party Content and Services

The platform may incorporate third-party content, integrations, or services. Use of third-party services is subject to the provider’s terms. Nivara does not endorse third-party products or services and is not liable for their availability, practices, or policies.

Privacy and Data Protection

Nivara collects and processes personal information in accordance with its Privacy Policy. By using the platform, you acknowledge the Privacy Policy and consent to the collection, use, and disclosure practices described therein.

Changes to Terms

Nivara may revise these Terms from time to time. Material changes will be posted on jcinova.tech with an updated effective date. Continued use of the services after posting changes constitutes acceptance of the revised Terms.

Disputes and Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada. Any disputes arising from or related to these Terms shall be brought in the courts of Ontario. Parties agree to pursue good-faith negotiations prior to initiating litigation.

Account Management

Certain features of Nivara require user accounts. You are responsible for providing accurate registration information and keeping your account secure.

Keep account information current and accurate. Failure to maintain accurate information may impact your access to courses or administrative communications.

Protect your account credentials and do not share your password. Notify Nivara promptly if you suspect unauthorized access. We advise using strong, unique passwords and enabling any available multi-factor authentication.

Accounts, subscription rights, and course enrollments are non-transferable unless expressly permitted by Nivara in writing.

If you suspect your account has been compromised, contact support immediately and follow the published procedures to secure or recover your account.

Nivara may suspend or restrict accounts that violate these Terms, present security risks, or for which payment obligations are not met. Suspension is a protective measure and may be lifted once the underlying issue is resolved.

User Conduct Rules

Users must adhere to the following rules when participating in Nivara courses, communities, and communications.

• Do not engage in unlawful activity or solicit illegal behavior.
• Respect other participants: no harassment, hate speech, or discriminatory conduct.
• Do not post spam, unsolicited advertising, or malicious content.
• Respect intellectual property rights; do not upload content that infringes third-party rights.
• Do not attempt to reverse-engineer, interfere with, or disrupt platform security.
• Follow course-specific guidelines and instructor directions.
• Report violations to Nivara rather than engaging in retaliatory behavior.

Intellectual Property Rights

All content provided by Nivara, including course materials, branding, images, and software, is protected by intellectual property laws and remains the property of Nivara or its licensors unless otherwise stated. Unauthorized use is prohibited.

• Do not reproduce, distribute, or publicly perform Nivara content without written permission.
• Do not create derivative works for commercial purposes from Nivara materials without authorization.
• Do not remove or alter copyright, activity, or other proprietary notices from Nivara content.

Limitation of Liability

To the extent permitted by law, Nivara and its affiliates will not be liable for indirect, incidental, special, or consequential damages arising from your use of the platform. Our total aggregate liability for direct damages is limited to amounts paid by you for the specific service giving rise to the claim in the prior 12 months, where applicable.

Termination

Nivara may suspend or terminate access to services for breach of these Terms, failure to pay fees, or other material reasons. Users may terminate their relationship by cancelling subscriptions and discontinuing use of the services.

Upon termination, access to course materials and community features may be revoked. Nivara may retain certain records for legal, tax, or operational purposes in accordance with applicable law and its privacy practices.

Communications and Notices

Nivara communicates through email, platform notifications, and posted notices on jcinova.tech. Notices related to these Terms will be delivered to the contact information provided in your account or posted on the site. It is your responsibility to monitor communications for important updates.

Applicable Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada, without regard to conflict of law principles. Venue for disputes shall be the courts located in Ontario.
